RESPONSIBILITIES

  • Represent the Company in all litigation matters where the company is or may become a party, including but not limited to, criminal, civil, and administrative cases.
  • Manage Quasi-Judicial Proceedings by representing the company before agencies such as the DOLE, NLRC, DTI, and BSP, often in collaboration with external counsel.
  • Handle Litigation Support and Cases outside the scope of the Compliance Group, including responding to Notices of Garnishment, Small Claims, and Demand Letters.
  • Oversee Civil, Criminal, and Labor Cases filed by or against the company's various entities (GFI, GXI, or FLI).
  • Provide Support for Contracts by reviewing litigious contracts and provisions.
  • Advisory and Internal Counsel
  • Advise the Company's Executives on all matters that may result in probable litigation.
  • Provide Legal Advice and Counsel to all departments when necessary.
  • Support Customer Experience (CX) teams with legal advice on matters requiring Executive Escalations, waivers, and claims.
  • Support Operations regarding the implementation and remedies in case of breach of contracts, terms and conditions.
  • Operations and Fraud Coordination
  • Support Operations by providing legal guidance on implementing contracts, terms, and conditions, and determining remedies for breaches.
  • Develop and implement strategies for preventive litigation to proactively minimize the company's legal exposure.
  • Lead internal coordination on all legal matters related to fraud cases, including advising on evidence gathering, regulatory reporting, and appropriate legal action.
  • Labor and HR Support
  • Advise and Recommend to the Human Resource Group (HRG) on matters relating to labor relations and employees positive discipline.
  • Assist HRG in the preparation of documentary proofs against an erring employee and in the execution of Notice to Explain and Notice of Decision.
  • Assist in Administrative Proceedings involving employees misconduct and disciplinary proceedings, especially when the employee is represented by counsel.
  • Special Projects
  • Work on special projects and those assigned by the Head-Litigation and Chief Legal Officer (CLO).

QUALIFICATIONS

  • Superior knowledge and understanding of law, particularly in litigation, labor, and relevant regulatory areas.
  • Proven experience in handling civil, criminal, and administrative cases.
  • Core Competencies
  • Above-average communication skills (written and verbal) for clear articulation of legal positions.
  • High-level of interpersonal skill to effectively interact with various stakeholders, including court personnel, partners, and internal teams.
  • Business Know-how or the ability to comprehend and incorporate business decisions into legal strategy.
  • Aptitude to learn new areas of the law quickly and effectively.
  • Highly honed organizational skills with the ability to manage multiple complex cases simultaneously.
  • Capable in initiating a negotiation process and driving favorable outcomes for the company.
  • Demonstrated Integrity in dealing with stakeholders, partners, external parties, and the court.
