Job Description

Industry: Renewable Energy/Power

Work Location: Makati/onsite daily

Job Purpose: To Lead and Manage all Commercial, Contract Administration, Cost Control, Risk, and Insurance.

DUTIES AND RESPONSIBILITIES:

Pre Contracts Management

  1. Review of tender packages to contractors, suppliers and consultants for completeness and correct order.
  2. Monitor the tender process and ensure all queries are answered timely to all bidders and submissions follow correct protocols
  3. Maintain a record log of all documents
  4. Advise on the most appropriate contract type for the given works to be undertaken, EPC, Supply Contract, Agreements, etc..
  5. Lead negotiations with Contractors, Suppliers, Consultants, coordinating with ETS Technical Team and with our internal and external Legal Counsel to finalize contract document terms and conditions and all documents are correctly formatted and referenced ready for top management signoff

Document Management

  1. Setting up tracking tools to monitor procurement, payment and commercial issues for up and coming projects
  2. Ensure the chosen Document Management System for a project is correctly set up and implemented
  3. Ensure Contract documents through electronic means are all stored and controlled.

Contract Management

  1. Review and finalize with technical and legal all outgoing letters to final sign off and transmittal.
  2. Understand legal and contractual requirements to manage projects within given borders and to support legal clarifications as needed.
  3. Monitor and coordinate with Project Teams that all correspondence, letters, transmittals, RFI's, Change Orders, Time Programme submissions etc. are being replied to within the response times set out in the Contract and the correspondence tracker are up to date
  4. Prepare Change Instructions, lead negotiations with Contractors and suppliers on Change Order Requests to review and agree the issuance of Change Orders.
  5. Oversee and manage the complete Contract life cycle and commercial execution from Notice-to-Proceed (NTP), Partial Acceptance Certificate (PAC) to Final Completion Acceptance Certificate (FCAC) and all milestones, requirements, warranties and guarantees are met.

Cost Management

  1. Establish payment system to track if payments are made in accordance to the Contract
  2. Establish acceptance criteria for each payment milestone and what supporting documentations are required along with the invoice for the issuance by the Owner of Certification of Milestone Completion
  3. Monitor and process Request for Payment (RFP) to ensure payments are on time and all supporting document are provided in accordance to contract requirement.
  4. Manage, review and evaluate Change Order Requests received from Contractors and Suppliers
  5. Coordinate with project team to set up a budget monitoring tracking system and on a monthly basis review to establish budget status to determine expenditure, committed and uncommitted costs, remaining budget and produce a budget report.

Risk Management

  1. Set up, manage and update Project Risk Register. Conduct detailed monthly reviews with the ETS and Project Teams at site to review, revise and update. Report and update of risk reviews to senior management on a monthly basis

Insurance & Bonds

  1. Oversee and maintain a register that all Insurances, Bonds and Securities are in place and up to date and provided in accordance with the Contract Provisions.

ROW & Business Development Support

Assist the Business Development group for Power, Solar, Hydro project set up, in particular securing right of way (ROW) and all permitting under the responsibility of the Owner devising action plans to secure ROW and setting up trackers to monitor ROW issues.

EDUCATION: Bachelor of Science in Engineering (any Engineering field) or Business Management or equivalent Master's units or degree (an advantage)

PROFESSIONAL EXPERIENCE:

  1. At least with 10-15 years in Construction/Contractor, Contract Management and/or Project Management relevant Experience
  2. Have worked for both Contractor AAA/AAAA and Owners Team
  3. Have overseas work experience in Commercial, Contract and Cost Control
  4. May have a basic speaking and understanding of Chinese language for direct discussions and negotiations with Chinese contractors and suppliers
