Your Role

The Litigation Unit Head is responsible for leading and overseeing the day-to-day litigation functions of the department, ensuring timely loan recovery through legal action, dacion en pago, amicable settlement, compromise, and other recovery strategies. The role also represents the Bank in the filing and prosecution of cases, ensures the achievement of litigation targets, and supervises and monitors the performance and daily activities of the Litigation team.

Your Impact

Litigation and legal functions

1.) Conducts extensive review of loan accounts (except credit cards, Personal and Salary Loans) endorsed for legal action, which maybe in the form of:

• Foreclosure of REM and Chattel Mortgage;

• Filing of cases (collection, replevin, writ of possession, estafa, BP 22, etc.);

• Preparation of appropriate recommendation for CC's approval (i.e. dacion en pago, waiver of penalty charges, etc.)

2.) Acts as counsel for the bank in cases involving NPLs/ITLs of the bank;

3.) Attends Court hearing and meetings with clients, arbiters, court personnel, officer of the concerned govt. agencies, etc.;

4.) Prepares/sends final legal demand letters and makes the necessary requests with the concerned units/depts. for any lacking/missing loan and/or collateral documents;

5.) Prepares legal opinion involving endorsed NPLs/ITLs;

6.) Conducts research and review of legal/loan documents, contracts, etc.;

7.) Refers cases to external legal counsel for appropriate handling and monitors the monthly progress thereof;

8.) Maintains ensure proper filing of folders/documents under ITL accounts;

9.) Assists in the preparation and sending of reply letters; and

10.) Provides notarial services

Auction sale and related functions

1.) Prepares bid document and compute the recommended bid price:

2.) Attends/participates in the conduct of auction sale;

3.) Process issuance of Certificate of Sale.

Sales Contract Receivables documents related functions

Signing of final demand letter and notarial rescission documents.

Your Profile

  • Graduate of Bachelor of Laws; Bar Passer.
  • At least five (5) years of work experience in the practice of law, particularly in litigation.
  • At least three (3) years of experience in a managerial position in a reputable bank.
  • Active in court litigation and knowledgeable in banking laws and regulations.
  • Strong communication and negotiation skills; computer literate, analytical, proactive, and a team player.
