- Role
This candidate is responsible for the strategic management of all contractual claims and dispute resolution activities on the project.
The role leads the identification, development, and defence of claims relating to Extension of Time (EOT), disruption, prolongation, and quantum, ensuring compliance with the FIDIC Pink Book claims procedures.
The position will be an influential member of the claims team that will include, planners, and commercial staff to ensure that all claims are contractually robust, evidence-based, and positioned for negotiation, DB referral, or arbitration if necessary.
The role will protect the contractual and financial interests of the Contractor while supporting the commercial strategy of the project.
- Key Responsibilities
Assist in the formulation, development and implementation of the overall claims strategy for the project.
Identify potential claims and commercial opportunities early.
Advise the Project Director and Commercial Lead on contractual risks and entitlements.
Establish and maintain a claims management framework, schedules and the likes
- Identification of Contractual Entitlement - Interpret and apply FIDIC Pink Book provisions, particularly relating to:
- Variations
- Third party delays (Local Governments and statutory authorities)
- Employer delay (e.g. Access)
- Suspension
- Unforeseen conditions
- Changes in law
- Payment issues
- Manage the preparation of contractual notices and claims
- Lead and prepare EOT claims and delay analysis.
- Thorough understanding of delay methodologies including:
- Time Impact Analysis
- Windows Analysis
- Impacted As-Planned
- As-Planned vs As-Built
- Ensure robust cause-and-effect demonstration between events and critical path delay.
- Direct preparation of disruption claims and productivity loss assessments.
- Oversee development and wider team understanding of:
- Measured mile analysis
- Labour and plant inefficiency claims
- Resource disruption assessments.
- Quantum and Cost Claims
- Lead the assessment and preparation of quantum claims, including:
- Prolongation costs
- Head office overheads
- Additional preliminaries
- Disruption and Plant and labour inefficiencies
- Escalation-related claims
- Ensure all claims are supported by detailed records and financial analysis.
- Dispute Resolution - Lead the preparation of claims for:
- Engineer's determinations
- Dispute Avoidance / Adjudication Board (DB) proceedings
- Arbitration (if required)
- Coordinate with external legal advisors and expert witnesses.
- Support the project leadership in commercial negotiations with the Employer and Engineer.
Required Experience
- Minimum 7-10 years experience in construction claims and dispute management with extensive experience working under FIDIC contracts, particularly the Pink book / MDB Harmonised Edition.
- Proven experience and successes in major EOT claims, delay and disruption claims, Quantum assessment.
- Experience preparing cases for DB, arbitration, or international disputes.
- Previous experience managing claims teams.
- Preferred but not essential work experience in the Philippines.
Qualifications
- Degree in one of the following: Quantity Surveying, Civil Engineering or other construction related discipline. Preferred professional qualifications: MICE, MRICS, MCIArb
